These Terms and Conditions (the “Terms”) set the rules for accessing and using the eocube.ro platform and any data created or distributed by the ROCS Project through the eocube.ro platform (collectively, the “ROCS Data”). By accessing, downloading, using, or redistributing the ROCS Data, you accept and agree to be bound by these Terms.
1 Definitions
- Consortium / ROCS Project Consortium : the group of institutions participating in the ROCS Project and responsible for operating the eocube.ro platform and distributing ROCS Data.
- Platform: the eocube.ro website and any associated services, APIs, storage or compute resources operated by the Consortium.
- ROCS Data: any dataset, product, derivative, documentation, or metadata created, curated, hosted, or distributed by the ROCS Project via the Platform, regardless of file format or delivery method.
- User / Data Consumer (DC): any individual or legal entity that accesses the Platform or uses the ROCS Data.
- Derived Product: any output generated by transforming, analyzing, subsetting, combining, or otherwise processing the ROCS Data.
- Third‑Party Content: data, software, services, or documentation not owned by the Consortium but made accessible via the Platform.
2 Scope and Acceptance
2.1. These Terms govern your access to and use of the Platform and ROCS Data.
2.2. If you use the Platform or access ROCS Data on behalf of an organization, you represent and warrant that you are authorized to bind that organization, and “you” includes that organization.
2.3. If you do not agree with these Terms, do not access or use the Platform or ROCS Data.
3 Registration, Accounts, and Access Controls
3.1. Access to certain ROCS Data may require registration, identity verification, and/or approval by the Consortium.
3.2. You must provide accurate, current, and complete information during registration and keep your credentials secure. You are responsible for all activities under your account.
3.3. The Consortium may modify access controls, suspend, or terminate accounts to protect the Platform, other users, or applicable legal/contractual obligations.
4 Licence to Use ROCS Data
4.1 Licence Statement
Unless otherwise noted in a dataset‑specific notice, ROCS Data are licensed under the Creative Commons Attribution‑ShareAlike 4.0 International (CC BY‑SA 4.0). The full licence text is available at: https://creativecommons.org/licenses/by-sa/4.0/

4.2 Scope of Rights (Summary)
Under CC BY‑SA 4.0, you are free to:
- Share — copy and redistribute the material in any medium or format; and
- Adapt — remix, transform, and build upon the material, for any purpose, even commercially.
You must comply with the following conditions:
- Attribution (BY) — give appropriate credit to the ROCS Project Consortium, provide a link to the licence, and indicate if changes were made; and
- ShareAlike (SA) — if you remix, transform, or build upon the material, you must distribute your contributions under the same licence as the original.
- No additional restrictions — you may not apply legal terms or technological measures that legally restrict others from doing anything the licence permits.
Published Work: For any Published Work (e.g., articles, reports, websites, applications, visualizations) that incorporates or adapts ROCS Data, your Adapted Material must be released under CC BY‑SA 4.0, unless a dataset‑specific notice states otherwise.
4.3 Dataset‑Specific Licences
Some datasets may carry dataset‑specific licences or restrictions (e.g., embargoed, sensitive, or third‑party datasets). Where a dataset‑specific licence conflicts with this Section 4, the dataset‑specific licence prevails.
4.4 Prohibited Uses (independent of CC BY‑SA)
You may not:
- use the Platform or ROCS Data in violation of applicable law, export controls, or sanctions regimes;
- attempt to re‑identify individuals from anonymized or aggregated data;
- misrepresent the provenance of ROCS Data or Derived Products;
- remove or alter copyright, attribution, licence, or other notices; or
- apply legal terms or technological measures that prevent others from doing anything the CC BY‑SA licence permits.
4.5 Attribution and Citation
When you publish results or share Derived Products, provide appropriate credit to the Consortium and the specific dataset(s), and include a link to the licence. Where feasible, link to the dataset landing page on eocube.ro and indicate changes. Example acknowledgement:
“We acknowledge the ROCS Project Consortium for providing ROCS Data via the EOCube.RO platform (Dataset: , Version: , Accessed: <YYYY‑MM‑DD>), licensed under CC BY‑SA 4.0 (https://creativecommons.org/licenses/by-sa/4.0/).”
Where Third‑Party Content is used, comply with all third‑party attribution requirements.
4.6 Redistribution and ShareAlike
You may redistribute ROCS Data or Derived Products provided that you:
- license any Adapted Material under CC BY‑SA 4.0;
- include these Terms or a link to them, and the CC BY‑SA 4.0 licence notice/link;
- preserve all notices (copyright, attribution, licence) and indicate changes; and
- do not impose further restrictions that would prevent recipients from complying with CC BY‑SA 4.0.
Note: If a dataset‑specific notice designates a different licence, that licence governs redistribution for that dataset.
4.7 No Transfer of Ownership
All intellectual property rights in and to ROCS Data remain with the Consortium or its licensors. This Section 4 grants a licence only and does not transfer ownership.
5 Acceptable Use of the Platform
5.1. You must not interfere with or disrupt the Platform, attempt unauthorized access, or misuse API endpoints, compute, or storage quotas.
5.2. You must not upload or distribute malware, or content that is unlawful, defamatory, or infringing.
5.3. The Consortium may rate‑limit, suspend, or terminate access to ensure Platform stability and security.
6 Third‑Party Content
6.1. The Platform may make available Third‑Party Content under terms specified by the relevant provider. You are responsible for complying with those terms.
6.2. The Consortium does not control and is not responsible for Third‑Party Content. Inclusion or linking does not imply endorsement.
7 Data Quality, Updates, and Support
7.1. ROCS Data are provided “as is” and “as available”. Datasets may be updated, corrected, reprocessed, or withdrawn.
7.2. The Consortium may publish versioned releases and change logs. It is your responsibility to ensure you are using appropriate versions for your use case.
7.3. The Consortium may, but is not obligated to, provide user support, documentation, or tools.
8 Privacy
Processing of personal data on or through the Platform is governed by the EOCube.RO Privacy Notice (separate document). Where your use involves personal data, you agree to comply with applicable data‑protection law, including GDPR where applicable, and to implement appropriate technical and organizational measures.
9 Warranties and Disclaimers
9.1. The Consortium does not warrant that ROCS Data or the Platform will be error‑free, complete, or fit for a particular purpose, nor that access will be continuous or uninterrupted.
9.2. To the maximum extent permitted by law, the Consortium disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.
10 Liability and Indemnity
10.1. To the maximum extent permitted by law, the Consortium shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of profits, revenue, data, or use, arising from or related to your use of ROCS Data or the Platform.
10.2. In jurisdictions where limitation of liability is restricted, the Consortium’s aggregate liability shall not exceed EUR 100.
10.3. You agree to indemnify and hold harmless the Consortium and its members, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform or ROCS Data, your Derived Products, or your breach of these Terms.
11 Export Controls and Sanctions
You represent that you are not a sanctioned party and that you will not access or use ROCS Data or the Platform in violation of EU, UK, or U.S. export control and sanctions laws.
12 Suspension and Termination
12.1. The Consortium may suspend or terminate your access to the Platform or specific datasets if you breach these Terms or if required by law or contractual obligations.
12.2. Upon termination, your licence to use ROCS Data survives for copies already lawfully obtained, subject to ongoing compliance with these Terms and any dataset‑specific obligations (including attribution and redistribution conditions).
13 Changes to the Terms and to the Platform
13.1. The Consortium may revise these Terms from time to time. Material changes will be announced via the Platform with reasonable notice where feasible. Continued use after changes become effective constitutes acceptance of the revised Terms.
13.2. The Consortium may modify, suspend, or discontinue the Platform or any dataset at any time.
14 Governing Law and Jurisdiction
These Terms are governed by the laws of Romania and applicable EU law. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Romania, without regard to conflict‑of‑laws rules.

16 Entire Agreement and Miscellany
These Terms constitute the entire agreement between you and the Consortium regarding the Platform and ROCS Data and supersede any prior agreements on the same subject matter. If any provision is held invalid or unenforceable, the remainder will continue in full force and effect. Failure to enforce a provision is not a waiver.
